About These Terms
These Terms of Service ("Terms") govern your access to and use of the LeasePilot platform, including our websites, applications, and related services (collectively, the "Services"), operated by LeasePilot Pty Ltd ("LeasePilot", "we", "us", or "our").
By creating an account, clicking to accept these Terms, or otherwise using the Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
We may offer additional features, beta programs, or optional modules from time to time. Such offerings may be subject to supplementary terms presented at the time of use.
SECTION 02
Who We Are
LeasePilot provides a software platform that assists Australian real estate agencies with tenant-related workflows, including verification data, tenancy records where entered by subscribers, optional scoring outputs derived from such records, and tools that allow tenants to access certain information about themselves and to participate in optional review and dispute processes.
LeasePilot is not a real estate agency, property manager, law firm, credit reporting body, or government registry. We do not make leasing decisions on behalf of any user. Any decision to rely on information available through the Services remains solely with the person or organisation making that decision.

SECTION 03
User Types
The Services are designed for two primary categories of users, who may be subject to different functional rules within the product:
- Agency users: staff of a subscribing real estate agency who access the agent dashboard (including administrators and invited agents).
- Tenant users: individuals who create or claim a tenant portal account to view permitted information, submit reviews where available, and use support tools.
Certain internal LeasePilot personnel may access restricted administrative interfaces for security, support, and compliance. Their use is governed by internal policies and confidentiality obligations.
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity that occurs under your account except where caused solely by a failure of our security controls.
SECTION 04
Agency User Terms
Subscription and access
Access to agency features generally requires an active subscription or trial as described at signup or in your order documentation. Fees, billing cycles, and feature limits may apply. We may suspend access for non-payment where permitted by law and your agreement with us.
Agency responsibilities
- You must hold appropriate licences and comply with applicable real estate and privacy laws when using the Services.
- You must obtain any required consent from tenants before collecting, entering, or disclosing their personal information in or through the Services.
- You must use tenant data only for legitimate tenancy-related purposes and in accordance with your own privacy notices and these Terms.
- You must ensure that information you input (including inspection notes and tenancy details) is accurate to the best of your knowledge and not misleading.
Invited staff
Agency administrators may invite additional agents. The agency is responsible for invitations issued under its account and for revoking access when staff leave or no longer require use of the Services.
SECTION 05
Tenant User Terms
Tenant portal features are intended for individuals who have a genuine connection to tenancy records held in the platform, whether because they self-enrolled, were enrolled by an agency, or completed a permitted claim flow.
Depending on your account status, you may be able to view certain score or history information, submit reviews of past agencies where the product allows, participate in dispute mediation, and contact support. Availability of features may depend on agency activity, subscription settings, and verification steps.
Reviews and messages you submit must be truthful, relevant to the tenancy in question, and free of unlawful content (including defamatory or discriminatory material). We may moderate, withhold publication, or remove content that violates these Terms or our policies.
SECTION 06
Dispute Resolution
Where the Services include review or mediation workflows, they are intended to provide a structured channel for parties to present information. LeasePilot may facilitate communication, apply published moderation rules, and record outcomes that the product is designed to support (such as maintaining, removing, or amending the publication status of a review in accordance with documented resolution types).
Mediation through the platform is not a substitute for legal advice or court proceedings. We are not obliged to achieve a particular outcome. Timeframes stated in the user interface (for example, target response windows) are goals and may vary for operational reasons.
You agree to cooperate in good faith with reasonable requests for information during an active dispute, subject to your legal rights.
SECTION 07
Intellectual Property
The Services, including software, branding, documentation, and aggregated analytics we generate (excluding your raw personal information), are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for their intended purpose during your subscription or permitted trial.
You must not copy, modify, decompile, or reverse engineer the Services except where non-waivable law permits; scrape the Services in a manner that burdens our infrastructure; remove proprietary notices; or use our trademarks without prior written consent.
You retain rights to information you submit. You grant LeasePilot a licence to host, process, display, and distribute that information as needed to operate, secure, and improve the Services, including as described in our Privacy Policy.
SECTION 08
Data and Privacy
Our collection, use, and disclosure of personal information is described in the LeasePilot Privacy Policy, which forms part of your agreement with us. Agency users remain responsible for their own privacy compliance, including tenant notices and consents, when they collect or enter personal information into the platform.
We implement technical and organisational measures designed to protect personal information, but no online service is completely secure. You should use strong passwords and safeguard your devices.
SECTION 09
Accuracy of Information
Information displayed in the Services may originate from agency users, tenants, integrated systems, or automated calculations (such as score models). While we strive for reliability, we do not warrant that any output is complete, current, or error-free.
You should independently verify critical facts before making high-risk decisions. If you believe information is inaccurate, you should follow correction processes described in the product or contact support so we can route the request appropriately.
SECTION 10
Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law and other applicable law, the Services are provided on an "as is" and "as available" basis. We disclaim all implied warranties (including fitness for a particular purpose and non-infringement) except any non-excludable statutory guarantee.
To the extent permitted by law, neither LeasePilot nor its directors, employees, or contractors will be liable for indirect, consequential, special, or punitive damages; loss of profits, revenue, goodwill, or data; or business interruption arising from your use of the Services or reliance on any information obtained through the Services.
Where our liability cannot be excluded but can be limited, our aggregate liability arising out of or relating to these Terms or the Services in any twelve-month period is limited to the greater of one hundred Australian dollars (AUD $100) and the fees you paid to LeasePilot for the Services in that period (if any).
SECTION 11
Indemnification
You agree to indemnify and hold harmless LeasePilot and its affiliates, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Services; (c) your violation of law or third-party rights; or (d) information you submit or cause to be submitted to the platform, except to the extent caused by LeasePilot's gross negligence or wilful misconduct.
SECTION 12
Suspension and Termination
We may suspend or terminate access to the Services if we reasonably believe you have breached these Terms, pose a security risk, or must comply with law or a regulator. We will endeavour to give notice where practical, except where immediate action is required to protect users or the platform.
You may stop using the Services at any time. Agency accounts may also be closed in accordance with your subscription terms. Certain provisions of these Terms survive termination, including intellectual property, limitation of liability, indemnity, governing law, and dispute-related clauses intended to survive.
SECTION 13
Changes to These Terms
We may update these Terms to reflect changes in law, the Services, or our business. When we make material changes, we will provide notice through the Services or by email where appropriate. The "Last updated" date at the top of this page will also be revised.
If you continue to use the Services after changes take effect, you agree to the revised Terms. If you do not agree, you must cease use and may close your account where the product allows.
SECTION 14
Governing Law
These Terms are governed by the laws of Victoria, Australia. Subject to any non-waivable rights you may have, you submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
